AN ORDINANCE INCREASING THE LAW LIBRARY FEE ASSESSED ON NEW CASE FILINGS

WHEREAS, Section 39001 of the Counties Code (55 ILCS 5/5-39001) authorizes the County of DuPage to establish and maintain a county Law Library; and
WHEREAS in accordance with 55 ILCS 5/5-39001, the County Board may authorize a fee not to exceed twenty dollars ($20.00) on and after January 1, 2022; and
WHEREAS, the County Board may authorize the Clerk of the Eighteenth Judicial Circuit Court to charge and collect a fee in the amount of $20.00 in all civil cases upon the filing of the first pleading, paper or other appearance filed by each party and that such fee shall be in addition to all other fees and charges of the clerks; and
WHEREAS, Clerk of the Circuit Court presently charges and collects a Law Library fee of $18.00 as previously authorized by the DuPage County Board; and
WHEREAS, the Law Library Fee is necessary to defray the County's expense in maintaining the Law Library and the expense of the self-help center both located within the DuPage County Courthouse; and
WHEREAS, Section 27.1(b) of the Clerk of Courts Act establishes four (4) fee schedules for the assessment of fees and costs relating to the filing of pleadings to initiate new civil actions, and three (3) fee schedules relating to the filing of appearances in civil actions.
NOW, THEREFORE BE IT ORDAINED by the DuPage County Board that, effective on June 1, 2026, the Law Library Fee charged by the Clerk of the Circuit Court shall be:
Schedule 1 New Case Civil Action - $20.00
Schedule 2 New Case Civil Action - $20.00
Schedule 3 New Case Civil Action - $20.00
Schedule 1 Appearance in a Civil Action - $20.00
Schedule 2 Appearance in a Civil Action - $20.00
BE IT FURTHER ORDAINED that the DuPage County Code of Ordinances is hereby amended by adding a section, to be numbered as Chapter 9-20, which reads as follows:
“9-20: - LAW LIBRARY FEES IN CIVIL CASES.
The fees of the Clerk of the Eighteenth Judicial Circuit shall include these fees to be collected in addition to the following Civil Case Schedules by the Clerk of the Circuit Court for the maintenance and operation of the County Law Library.
In addition to Schedule 1 New Case Civil Action - $20.00
In addition to Schedule 2 New Case Civil Action - $20.00
In addition to Schedule 3 New Case Civil Action - $20.00
In addition to Schedule 1 Appearance in a Civil Action -$20.00
In addition to Schedule 2 Appearance in a Civil Action -$20.00”
BE IT FURTHER ORDAINED, that the DuPage County Board directs this ordinance to be sent for codification and publication in the DuPage County Board of Ordinances to the appropriate codifying entity upon signature by the DuPage County Board Chair; and
BE IT FURTHER ORDAINED, that the DuPage County Board directs the Circuit Court Clerk of the Eighteenth Judicial Court to remit such collected fees to the DuPage County Treasurer on a monthly basis; and
BE IT FURTHER ORDAINED, that this ordinance takes effect immediately upon enactment; and
BE IT FURTHER ORDAINED, that the DuPage County Clerk is directed to immediately transmit a copy of the signed ordinance upon receipt to the Circuit Court Clerk of the Eighteenth Judicial Circuit, the Chief Judge of the Eighteenth Judicial Circuit Court, the DuPage County Finance Department and the DuPage County Treasurer.
