APPROVAL OF AMENDMENT 8-SUBSTANTIAL TO THE 2021 ACTION PLAN ELEMENT OF THE 2020-2024 DU PAGE COUNTY CONSOLIDATED PLAN FOR HOUSING AND COMMUNITY DEVELOPMENT

WHEREAS, DuPage County has participated in the Community Development Block Grant program since 1975; and
WHEREAS, DuPage County has participated in the Emergency Shelter Grant Program since 1987, and;
WHEREAS, The Homeless Emergency Assistance and Rapid Transition to Housing Act of 2009 (“Hearth Act”), enacted into law on May 20, 2009, consolidated three of the separate homeless assistance programs administered by the U.S. Department of Housing and Urban Development (“HUD”) under the McKinney-Vento Homeless Assistance Act into a single grant program, and revised the Emergency Shelter Grant program and renamed it as the Emergency Solutions Grant (“ESG”) program; and
WHEREAS, DuPage County has participated in the HOME Investment Partnerships Program (HOME) since 1992; and
WHEREAS, these programs provided an approximate total of $6 million in new Federal funding to DuPage County in 2021, and the county also had available an approximate additional $1.6 million in project income and reallocated funds from previous years, said funds being available for Housing and Community Development activities benefiting low- and moderate-income persons, the homeless, and persons with special needs; and
WHEREAS, a requirement of these programs is the preparation of a Consolidated Plan for Housing and Community Development (ConPlan); and
WHEREAS, the 2020-2024 ConPlan was adopted by the DuPage County Board on March 10, 2020 by Resolution HHS-R-0068-20: and
WHEREAS, the 2021 Action Plan Element of the 2020-2024 ConPlan was adopted by the DuPage County Board on February 9, 2021 by Resolution HHS-R-0086-21; and
WHEREAS, Amendment One-Minor to the 2021 Action Plan Element of the 2020-2024 ConPlan was completed in May 2021 to account for an increased allocation of Community Development Block Grant (CDBG) funds and to re-program $400,000 (FOUR HUNDRED THOUSAND and 00/100 DOLLARS) of CDBG funds in prior year resources; and
WHEREAS, Amendment Two-Substantial to the 2021 Action Plan Element of the 2020-2024 Con Plan was approved by the DuPage County Board on February 8, 2022 by resolution HHS-R-0053-22 for the purpose of adding $827,000 (EIGHT HUNDRED TWENTY-SEVEN THOUSAND and 00/100 DOLLARS) of CDBG funds in prior year resources to the 2021 action plan and to reprogram $173,000 (ONE HUNDRED SEVENTY-THREE THOUSAND and 00/100 DOLLARS) of CDBG funds for the purpose of funding $1,000,000 (ONE MILLION and 00/100 DOLLARS) of CDBG funds for improvements to the air handling unit system at the DuPage County Care Center and for updating certifications required by HUD that included newly effective Section 3 language; and
WHEREAS, Amendment Three-Minor to the 2021 Action Plan Element of the 2020-2024 ConPlan was completed in February 2022 for the purpose of adding $116,919.40 (ONE HUNDRED SIXTEEN THOUSAND NINE HUNDRED NINETEEN and 40/100 DOLLARS) of CDBG funds in prior year resources, converting $87,500 (EIGHTY SEVEN THOUSAND FIVE HUNDRED and 00/100 DOLLARS) of Neighborhood Stabilization Program (NSP) program income into Community Development Block Grant (CDBG) program income, increasing funding for two projects, and decreasing funding for one project; and
WHEREAS, Amendment Four-Substantial to the 2021 Action Plan Element of the 2020-2024 ConPlan was approved by the DuPage County Board on January 24, 2023 under Resolution #HS-R-0042-23 for the purpose of submitting DuPage County’s HOME-ARP Allocation Plan which includes DuPage County’s plan to spend $6,505,249 (SIX MILLION, FIVE HUNDRED FIVE THOUSAND, TWO HUNDRED FORTY-NINE and NO/100 DOLLARS) in HOME-ARP funds awarded to DuPage County through the US Department of Housing and Urban Development with funds authorized under the American Rescue Plan Act legislation; and
WHEREAS, Amendment Five-Minor to the 2021 Action Plan Element of the 2020-2024 ConPlan was completed in February 2023 for the purpose of adding $59,139 (FIFTY-NINE THOUSAND ONE HUNDRED THIRTY-NINE and 00/100 DOLLARS) of CDBG funds in prior year resources and reprogram $60,000 (SIXTY THOUSAND and 00/100 DOLLARS) of CDBG funding from Administration and Planning to the Single-Family Rehabilitation project; and
WHEREAS, Amendment Six-Minor to the 2021 Action Plan Element of the 2020-2024 ConPlan was completed in April 2023 for the purpose of reducing the HOME Investment Partnerships (HOME) Program Community Housing Development Organization (CHDO) set-aside by $108,587.60 (ONE HUNDRED EIGHT THOUSAND FIVE HUNDRED EIGHTY- SEVEN and 60/100 DOLLARS) and reprogramming those HOME funds to new construction; and
WHEREAS, Amendment Seven-Minor to the 2021 Action Plan Element of the 2020-2024 ConPlan was completed in May 2025 to increase HUD’s HOME-ARP allocation to a total of $6,515,003 (SIX MILLION FIVE HUNDRED FIFTEEN THOUSAND THREE and 00/100 DOLLARS); and
WHEREAS, Amendment Eight-Substantial to the 2021 Action Plan Element of the 2020-2024 ConPlan is recommended for the purpose of amending the HOME-ARP Allocation Plan to change the method of distributing funds, carry out an activity not previously described in the plan, and change the purpose and scope of an activity, specifically increasing HOME-ARP funding under the supportive service and administration and planning categories, and decreasing HOME-ARP funding under the affordable rental housing development category; and
WHEREAS, Amendment Eight-Substantial to the 2021 Action Plan was approved by the DuPage County Community Development Commission Executive Committee and HOME Advisory Group on September 1, 2026 and by the DuPage County Human Services Committee on September 15, 2026; and
WHEREAS, HUD Notice CPD 21-10 Requirements for the Use of Funds in the HOME-American Rescue Plan Program, Section V. C. 6., substantial amendments to the HOME-ARP Allocation Plan allows for a 15-day public comment period, the 15-day public comment period was completed on September 14, 2026 and a public hearing was held on September 9, 2026, and, in accordance with federal regulations governing the development of consolidated plans, all comments were included in the final draft of the Substantial Amendment along with responses to these comments.
NOW, THEREFORE, BE IT RESOLVED that the DuPage County Board hereby approves Amendment Eight-Substantial to the 2021 Annual Action Plan Element of the 2020-2024 DuPage County Consolidated Plan for the purpose of amending the HOME-ARP Allocation Pan to change the method of distributing funds, carry out an activity not previously described in the plan, and change the purpose and scope of an activity, specifically increasing HOME-ARP funding under the supportive service and administration and planning categories, and decreasing HOME-ARP funding under the affordable rental housing development category; and
BE IT FURTHER RESOLVED, that the Chair of the DuPage County Board is authorized and directed to sign any certifications or forms required by the U.S. Department of Housing and Urban Development to enact the Substantial Amendment and the Clerk is hereby authorized and directed to attest to such signature and affix the official seal thereto; and
BE IT FURTHER RESOLVED, that the Chair of the DuPage County Board is hereby authorized to approve amendments to said Action Plan as may be required by HUD; and
BE IT FURTHER RESOLVED, that the Chair of the DuPage County Board is hereby authorized and directed to sign each individual Agreement on behalf of DuPage County with municipalities and non-profit entities implementing specific projects identified in said Action Plan; and
BE IT FURTHER RESOLVED, that the Clerk is hereby authorized and directed to attest to such execution of each individual Agreement on behalf of DuPage County with municipalities and non-profit entities implementing specific projects identified in said Action Plan and affix the official seal thereto; and
BE IT FURTHER RESOLVED that the County Clerk be directed to send copies of each individual Agreement on behalf of DuPage County to each of the respective municipalities and non-profit entities implementing specific projects identified in said Action Plan and to the DuPage Community Development Commission.
