FIRST AMENDMENT TO THE INTERGOVERNMENTAL AGREEMENT BETWEEN THE COUNTY OF DUPAGE, ILLINOIS AND

THE MILTON TOWNSHIP HIGHWAY DEPATMENT FOR

THE NATIONAL STREET DRAINAGE IMRPOVEMENT PROJECT

WHEREAS, the DuPage County Board heretofore adopted Resolution SM-R-0005-26, an Intergovernmental Agreement (hereinafter the “Agreement”) between the County of DuPage (the “COUNTY”) and Milton Township Highway Department (the “TOWNSHIP”) for the National Street Drainage Improvement Project (the “PROJECT”) on June 9, 2026; and

WHEREAS, the current termination date of the Agreement requires that the PROJECT be completed on or before November 30, 2026; and

WHEREAS, after coordination with the TOWNSHIP, the COUNTY and TOWNSHIP have together determined that additional time is necessary to complete the PROJECT; and

WHEREAS, the Stormwater Management Committee recommends the adoption of the attached First Amendment to the Intergovernmental Agreement between the County of DuPage, Illinois and the Milton Township Highway Department for the National Street Drainage Improvement Project (the “FIRST AMENDMENT”) to extend the Agreement’s termination date, and the PROJECT’s completion date, until November 30, 2027; and

WHEREAS, all other provisions of the Agreement not expressly changed in this FIRST AMENDMENT shall remain the same in their entirety.

NOW, THEREFORE BE IT RESOLVED, that the attached FIRST AMENDMENT to the Intergovernmental Agreement between the County of DuPage, Illinois and the Milton Township Highway Department for the National Street Drainage Improvement Project, for Stormwater Management, to extend the Agreement’s termination date to November 30, 2027, is hereby accepted and approved; and that the Chair of the DuPage County Board is hereby authorized and directed to execute the FIRST AMENDMENT on behalf of the COUNTY; and

BE IT FURTHER RESOLVED that the DuPage County Clerk be directed to transmit certified copies of this Resolution and the attached FIRST AMENDMENT to the Milton Township Highway Department, 23W040 Poss St, Glen Ellyn, IL 60137, by and through the Stormwater Management Department.
