FIRST AMENDMENT TO INTERGOVERNMENTAL AGREEMENT WITH THE CITY OF WHEATON FOR THE TRANSFER OF OWNERSHIP OF WATER MAINS ON PORTIONS OF THE DUPAGE COUNTY ADMINISTRATION CAMPUS LOCATED WITHIN THE CITY OF WHEATON
WHEREAS, the City of Wheaton (“City”) and the County of DuPage (“County”) are public agencies within the meaning of the Illinois “Intergovernmental Cooperation Act,” and as authorized by Article 7, Section 10 of the Constitution of the State of Illinois to cooperate for public purposes; and
WHEREAS, the purposes of the Intergovernmental Cooperation Act and Article 7 of the Constitution of the State of Illinois include fostering cooperation among governmental bodies; and
WHEREAS, the City and the County (collectively the “Parties”) are committed to acting in the best interests of the citizens of their respective and collective communities; and
WHEREAS, the County owns and operates a campus of over 150 acres (“Campus”), which is currently located partially within the corporate boundaries of the City of Wheaton; and
WHEREAS, the Parties previously entered into an Intergovernmental Agreement Relating to Regulatory Control Over the DuPage County Governmental Campus in Wheaton, Illinois (the “Intergovernmental Agreement”) setting forth, inter alia, the Parties respective responsibilities regarding utilities on the portions of the Campus in the City of Wheaton; and
WHEREAS, the Parties find it in each of their best interests to transfer ownership of the water mains within the City of Wheaton portion of the Campus from the County to the City, with the County continuing to provide and be responsible for the maintenance of the water mains; and
WHEREAS, the First Amendment to Intergovernmental Agreement Between the City of Wheaton and the County of DuPage, Illinois Relating to Regulatory Control Over the DuPage County Governmental Campus in Wheaton, Illinois (the “First Amendment”), attached hereto as Exhibit A, sets forth the transfer of the maintenance responsibilities and the transfer of ownership of the water mains on the City of Wheaton portion of the Campus; and
WHEREAS, the County finds that the First Amendment will be effective immediately upon the City of Wheaton’s approval of said First Amendment; and
WHEREAS, the DuPage County Board has reviewed the attached First Amendment and has determined that entering into the First Amendment is in the best interest of the City of Wheaton, the County, and the respective residents of the City of Wheaton and County.
NOW, THEREFORE, BE IT RESOLVED by the DuPage County Board that the attached First Amendment to the Intergovernmental Agreement (Exhibit A) between the City of Wheaton and the County of DuPage is hereby accepted and approved, and that the Chair of the DuPage County Board is hereby authorized and directed to execute the First Amendment on behalf of the County, and the DuPage County Clerk is hereby authorized to attest thereto; and
BE IT FURTHER RESOLVED that the DuPage County Clerk be directed to transmit certified copies of this Resolution and the attached First Amendment (Exhibit A) to the City Manager, City of Wheaton, 303 W. Wesley, Wheaton, IL 60187; the DuPage County Building and Zoning Department, the DuPage County Facilities Management Department and Barbara Reynolds, Assistant State’s Attorney, by and through the Facilities Management Department.
