DESIGNATION OF SURPLUS EQUITY FUND FEES

WHEREAS, the Illinois legislature has passed House Bill 4537 which has been signed into law as Public Act 104-0553 (the “Act”) effective July 10, 2026; and
WHEREAS, the Act authorizes the Treasurer to collect not more than $20 for each item sold at the annual tax sale and for each year that subsequent taxes are paid by a tax purchaser and that said fee be deposited into a surplus equity fund for claimants entitled to recovery under the Act; and
WHEREAS, said fee will begin to be collected following the due date of the second installment of property taxes collected by the Treasurer; and
WHEREAS, the Act requires that the County Board designate either that the funds be deposited up to a threshold determined to be sufficient for all such surplus equity claims with any excess being deposited into the County’s general fund or that all claims be paid out of the County’s Tort Liability Fund and all collected fees be deposited into the County’s general fund; and
WHEREAS, the Tort Liability Fund has sufficient funds to pay anticipated surplus equity fund claims; and
WHEREAS, the Finance Committee of the DuPage County Board has reviewed and recommends approval of the proposed amendment to the DuPage County Code.
NOW, THEREFORE, BE IT ORDAINED, that the surplus equity fund required by the Act shall be provided by the County Tort Liability Fund; and
BE, IT FURTHER ORDAINED, that all sums of money received pursuant to Section 21-296(a) of the Act be deposited into the County’s general fund for general county governmental purposes.
