MODIFICATION ONE TO COMMUNITY DEVELOPMENT COMMISSION AGREEMENT CD25-03 BETWEEN THE COUNTY OF DUPAGE AND THE CITY OF WEST CHICAGO

WHEREAS, DuPage County has participated in the Housing and Community Development Program since 1975; and
WHEREAS, the Community Development Commission Agreement CD25-03 was adopted by Resolution HS-R-0004-25 on February 11, 2025 as part of the 2025 Action Plan element of the 2025-2029 Consolidated Plan; and
WHEREAS, the Plan provided for a grant to the CITY OF WEST CHICAGO (SUBGRANTEE) in the amount of $600,000 for project CD25-03, for improvements of four residential streets and water main servicing the residents within the proposed service area, with additional improvements being made to the underground sewer infrastructure, sidewalks located along W. York Ave., from the dead end east to N. Oakwood Ave., Garden St. from Washington St. north to E. Grand Lake Blvd., Virgie Place from N. Oakwood Ave. east to Ingalton Ave., and Ingalton Ave. from E. Washington St. to E. Grand Lake Blvd., as well as installation of new street lighting along W. York Ave., known as York Ave. Area Water Main and Streets Rehabilitation Project; and
WHEREAS, on March 3, 2026, the County entered into an Agreement with SUBGRANTEE to implement this project (hereinafter, together with any previous modifications thereto, called "Agreement"); and
WHEREAS, SUBGRANTEE has requested Modification One to reduce the project scope to improve three residential streets and water main along two of the three residential streets servicing the residents within the proposed service area, with additional improvements being made to the underground sewer infrastructure and sidewalk curb ramps, located along W. York Ave., from the dead end east to N. Oakwood Ave., Garden St. from E. Washington St. north to E. Grand Lake Blvd., and Ingalton Ave. from E. Washington St. to E. Grand Lake Blvd.; and
WHEREAS, said Modification request has been approved by the DuPage County Community Development Commission Executive Committee on July 7, 2026 and the DuPage County Human Services Committee on August 4, 2026.
NOW THEREFORE BE IT RESOLVED by the County Board that said Modification One to Agreement between DuPage County and SUBGRANTEE attached hereto and herein incorporated by reference, is hereby approved; and
BE IT FURTHER RESOLVED, that the Chair of the DuPage County Board is authorized and directed to execute the Modification on behalf of DuPage County and the Clerk is hereby authorized and directed to attest to such execution and affix the official seal thereto; and
BE IT FURTHER RESOLVED, that the Chair of the DuPage County Board is hereby authorized to approve amendments to project CD25-03 so long as such amendments further the completion of said project and are in accordance with regulations applicable to the Community Development Block Grant Program and are in accordance with the policies of DuPage County and the DuPage Community Development Commission; and
BE IT FURTHER RESOLVED that the County Clerk be directed to send copies of this Resolution to Dave Shah, P.E., Assistant Director of Public Works, City of West Chicago, at 475 Main Street, West Chicago, IL 60185, and one copy to the Community Development Commission.
