FIRST AMENDMENT TO INTERGOVERNMENTAL AGREEMENT WITH THE CITY OF WHEATON FOR THE TRANSFER OF OWNERSHIP OF WATER MAINS ON PORTIONS OF THE DUPAGE COUNTY ADMINISTRATION CAMPUS LOCATED WITHIN THE CITY OF WHEATON
WHEREAS, the City of Wheaton ("City") and the County of DuPage ("County") are public agencies within the meaning of the Illinois "Intergovernmental Cooperation Act," and as authorized by Article 7, Section 10 of the Constitution of the State of Illinois to cooperate for public purposes; and
WHEREAS, the purposes of the Intergovernmental Cooperation Act and Article 7 of the Constitution of the State of Illinois include fostering cooperation among governmental bodies; and
WHEREAS, the City and the County (collectively the "Parties") are committed to acting in the best interests of the citizens of their respective and collective communities; and
WHEREAS, the County owns and operates a campus of over 150 acres ("Campus"), which is currently located partially within the corporate boundaries of the City of Wheaton; and
WHEREAS, the Parties previously entered into an Intergovernmental Agreement Relating to Regulatory Control Over the DuPage County Governmental Campus in Wheaton, Illinois (the "Intergovernmental Agreement") setting forth, inter alia, the Parties respective responsibilities regarding utilities on the portions of the Campus in the City of Wheaton; and
WHEREAS, the Parties find it in each of their best interests to transfer ownership of the water mains within the City of Wheaton portion of the Campus from the County to the City, with the County continuing to provide and be responsible for the maintenance of the water mains; and
