REIMBURSEMENT AGREEMENT
BETWEEN THE COUNTY OF DU PAGE AND UNION PACIFIC RAILROAD
EAST BRANCH DUPAGE RIVER TRAIL

WHEREAS, the County of DuPage (hereinafter "COUNTY"), in order to improve non-motorized mobility, safety, and accessibility within the County, proposes to construct a segment of the East Branch DuPage River Trail connecting the Great Western Trail to the Illinois Prairie Path (hereinafter "PROJECT"); and
WHEREAS, the Union Pacific Railroad (hereinafter "RAILROAD") owns certain property and rights-of-way that the PROJECT will affect; and
WHEREAS, the PROJECT will necessitate the procurement of professional engineering review services by the RAILROAD; and
WHEREAS, it is the responsibility of the COUNTY to reimburse the RAILROAD for the costs of such professional engineering review services; and
WHEREAS, it is necessary and in the best interest of the COUNTY to execute the attached Reimbursement Agreement with the RAILROAD.
NOW, THEREFORE, BE IT RESOLVED that the DuPage County Chair is hereby authorized and directed to sign on behalf of the COUNTY, and the County Clerk is hereby authorized to attest thereto, the attached AGREEMENT between the RAILROAD and the COUNTY; and
BE IT FURTHER RESOLVED that a certified and an original copy of the Resolution and Agreement be sent to the Union Pacific Railroad, by and through the DuPage County Division of Transportation.
