MEMORANDUM OF UNDERSTANDING
BETWEEN THE COUNTY OF DU PAGE, ILLINOIS
AND THE ILLINOIS STATE TOLL HIGHWAY AUTHORITY
EAST BRANCH DUPAGE RIVER TRAIL ALONG INTERSTATE 355
SECTION 19-00002-07-BT

WHEREAS, the County of DuPage (“COUNTY”), in order to provide improved non-motorized mobility and accessibility within the County, proposes to construct a segment of the East Branch DuPage River Trail (“TRAIL”), connecting the Great Western Trail to the Illinois Prairie Path, Section No. 19-00002-07-BT (“STUDY”) and;
WHEREAS, a cooperative Memorandum of Understanding is appropriate and is authorized by Article VII, Section 10 of the Illinois Constitution and the Intergovernmental Cooperation Act, 5 ILCS 220/1, et seq; and
WHEREAS, the COUNTY and the Illinois State Toll Highway Authority, hereafter referred to as (“TOLLWAY”), by this Memorandum of Understanding establish their respective responsibilities toward the STUDY as proposed; and
WHEREAS, the Memorandum of Understanding must be executed before the STUDY can begin.
NOW, THEREFORE, BE IT RESOLVED that the DuPage County Chair is hereby authorized and directed to sign on behalf of the COUNTY, and the DuPage County Clerk is hereby authorized to attest thereto, the attached Memorandum of Understanding with the TOLLWAY; and
BE IT FURTHER RESOLVED that one (1) original copy of this resolution and the Memorandum of Understanding be sent to the TOLLWAY, by and through the Division of Transportation.
