WHEREAS, a public hearing was held on November 1, 2023, in the DuPage County Administration Building, 421 North County Farm Road, Wheaton, Illinois at 2:30 P.M. before the DuPage County Zoning Hearing Officer and notice of said hearing was duly given; and

WHEREAS, a petition was presented at this hearing requesting the following zoning relief:

1. Conditional Use to reduce the interior side setback for an existing shed from required 3 feet to approximately 20 inches, where it has existed for at least 5 years.
2. Conditional Use to allow a 5' fence (50% open) within the 10' corner side yard setback, on the property hereinafter described:

LOT 128 IN CROWN ESTATES, BEING A SUBDIVISION IN SECTION 5, TOWNSHIP 40 NORTH, RANGE 11, EAST OF THE THIRD PRINCIPAL MERIDIAN, ACCORDING TO THE PLAT THEREOF RECORDED APRIL 23, 1963 AS DOCUMENT R63-12296, IN DUPAGE COUNTY, ILLINOIS; and

WHEREAS, the Zoning Hearing Officer, having considered in relation to the above requested zoning petition presented at the above hearing and at the recommendation meeting held on November 1, 2023, does find as follows:

FINDINGS OF FACT:
A. That petitioner testified that the subject zoning relief is to reduce the interior side setback for an existing shed from required 3 feet to approximately 20 inches, where it has existed for at least 5 years and to allow a 5' fence (50% open) within the 10' corner side yard setback.

B. That petitioner testified that she purchased the subject property approximately thirty (30) years ago and that the subject shed was existing prior to her purchasing of the property.

C. That petitioner testified that she expanded, reroofed, and resided the shed in 2014 and that it is in excellent condition.
