CHAIR'S REPORT / PRESENTATIONS  
Chair Conroy made the following remarks:  
Thank you to Colby and our team for the presentation and for framing the housing issues in  
DuPage. As we talk about Affordable Housing… I think it’s important to acknowledge the work  
this County is doing through our various programs. I’m particularly gratified to know we have  
set aside the $1.75 million dollars of federal HOME Investment Partnership funds for the  
affordable and supportive housing development in Glen Ellyn. I know Mary and the Community  
Services team will keep us in the loop as that project moves forward.  
Issues such as affordable housing, food insecurity, public safety, mental health are just some of  
the important issues that directly affect our residents.  
In the area of mental health, I want to respond to those of you who have reached out regarding  
the pending settlement of the Hurtado case. The State’s Attorney’s Office advises us that the  
settlement is still not finalized and any comments about the case are appropriate for executive  
session only. This case involved a 50-year-old woman who was mentally ill and died in the  
DuPage County jail. This was a horrific tragedy and an example of a perfect storm of failures.  
Too often, people like Mrs. Hurtado wind up incarcerated. Too often, there are long waits for the  
few beds… in the few publicly funded hospitals to accept people who need mental health  
treatment. And too often, mental health crises lead to physical crises that become life  
threatening. Moving forward, the responsibility to make and enforce any change that may be  
necessary lies with the Sheriff… the person responsible for the jail. In a situation such as this, it  
is reasonable for us, as elected officials to expect that the Sheriff has undertaken a painstaking  
review of events and policies and enacted new policies…so that such a tragedy does not occur  
again.  
As a County, we are working to support people suffering with mental health and addiction crises.  
With your help and with the DuPage Health Department, we are building the Crisis Recovery  
Center that will provide that needed mental health and addiction triage, keeping people out of  
jails and emergency rooms. The C-R-C is scheduled to come online late this summer. I believe it  
will make a life changing difference to those who so desperately need mental health and  
addiction services.  
Moving forward, I hope the Sheriff will do his part to maintain safety in the jail and provide the  
appropriate, necessary medical and mental health services to those in his care.

WHEREAS, County Contract 6736-0001 SERV was issued by the Procurement  
Division on December 1, 2023; and  
WHEREAS, the Finance Committee recommends changes as stated in the Change  
Order Notice to County Contract 6736-0001 SERV, issued to Mesirow Insurance  
Services, Inc., to provide Workers Compensation insurance, to increase the contract by  
$12,886 to pay for the adjusted Workers Compensation premium, resulting in an  
amended contract total of $212,637, an increase of 6.45%.

FINDINGS OF FACT:  
1. That petitioner testified that they seek the subject zoning relief to allow for the  
construction of a Planned Development on approximately 24.45 acres of land, and  
that the proposed development would include ten (10) detached dwelling units and  
sixty-one (61) attached dwelling units, a 14,172 square foot divisible shopping center,  
and two (2) place of assembly buildings that will total approximately 54,963 sq. ft., to  
be used for religious services, study, and education  
2. That at the public hearing, petitioner amended the requested zoning relief that was  
originally published as an exception to increase the height from 36 feet to  
approximately 47 feet, to increase the height to 40 feet.  
3. That petitioner testified that the proposed development would be serviced with water  
and sewer.  
4. That petitioner testified that the north parcel currently contains a one-story, 10,500  
square foot place of assembly building that would remain on the property and  
proposing a 17,900 square foot, one-story addition for education and services.  
5. That petitioner testified that the commercial building would include businesses that  
would be intended to be utilized by the residents of the development, such as a  
grocery store and other local commercial uses.  
6. That in supplemental documentation, petitioner indicated that the residential portion  
of the proposed development would be age-restricted (fifty-five years of age or older),  
as in accordance with the Housing for Older Persons Act of 1995.  
a. Furthermore, that petitioner testified the age-restricted development will lessen  
the impact of traffic and peak hour traffic particularly, because many of the  
residents will already be located within the planned development, minimizing  
traffic concerns.  
7. That petitioner testified that the single family detached dwelling units will be  
approximately 2,700 sq. ft. in size, the attached two-story dwelling units will be  
approximately 2,100 sq. ft. in size, and that there will be twenty-nine (29) attached  
condominium-type units with parking underneath the condominium building.  
8. That petitioner testified that they are increasing the existing parking by over 133  
parking spaces, with more than three hundred (300) parking spaces throughout the  
proposed development.  
9. That petitioner testified that a traffic study was completed by Eriksson Engineering  
and that no intersection improvements are proposed with the development as the there  
is an existing paved median on Route 83 and there would be minimal impact to the  
existing roadways.  
10. That petitioner testified that the density of the residential portion of the development  
is 5.4 units per acre and that the total Floor Area Ratio (FAR) of the development will  
be 0.25, meeting the R-4 Zoning Districts FAR maximum requirement.  
11. That petitioner testified that the proposed development is designed to be a  
low-density development, with plenty of park land and open space.  
12. That the Zoning Board of Appeals finds that the petitioner has demonstrated evidence  
for a Conditional Use for a Planned Development in the R-4 Zoning District, seeking  
10 detached and 61 attached dwelling units, 14,172 square foot divisible shopping  
center, and two place of assembly buildings that will total approximately 54,963 sq.  
ft. to be used for religious services, study, and education, with the following  
exception to increase the height from 36 feet to approximately 40 feet.  
13. Furthermore, that the Zoning Board of Appeals finds that the petitioner has  
demonstrated the required standards to approve a Conditional Use.  
STANDARDS FOR CONDITIONAL USES:  
1. That the Zoning Board of Appeals finds that petitioner has demonstrated that the  
granting of the Conditional Use is in harmony with the general purpose and intent of  
the Zoning Ordinance, and will not be injurious to the neighborhood, detrimental to  
the public welfare, or in conflict with the County’s comprehensive plan for  
development; and specifically, that the granting of the Conditional Use will not:  
a. Impair an adequate supply of light and air to the adjacent property as petitioner  
has demonstrated that the proposed development will meet the FAR of 0.25 of  
the R-4 Zoning District, and that with the additional open space, the proposed  
planned development will not impair an adequate supply of light and air to the  
adjacent properties.  
b. Increase the hazard from fire or other dangers to said property as petitioner has  
demonstrated that they will receive all required building permits for the proposed  
development and that they will meet all requirements from the Tri-State Fire  
Protection District, and therefore, will not increase the hazard from fire or other  
dangers to said property.  
c. Diminish the value of land and buildings throughout the County as petitioner has  
demonstrated that the proposed development will be consistent with the  
surrounding uses and will not diminish the value of land and buildings throughout  
the County.  
d. Unduly increase traffic congestion in the public streets and highways as petitioner  
has demonstrated that they have completed a traffic study by Ericksson  
Engineering and that the proposed development will be consistent with the  
surrounding uses and that there will not be an unduly increase in traffic  
congestion in the public streets and highways.  
e. Increase the potential for flood damages to adjacent property as petitioner has  
demonstrated that the proposed development will comply with the Stormwater  
Ordinance and all wetland requirements and that there will not be an increase in  
the potential for flood damages to adjacent properties.  
f. Incur additional public expense for flood protection, rescue or relief as petitioner  
has demonstrated that the proposed development will comply with the  
Stormwater Ordinance and all wetland requirements, and that the proposed  
development will not incur additional public expense for flood protection, rescue,  
or relief.  
g. Otherwise impair the public health, safety, comfort, morals, or general welfare of  
the inhabitants of DuPage County as petitioner has demonstrated that the  
proposed development will be consistent with other developments along Route 83  
and that the proposed development will be an added benefit to the surrounding  
area that will impair the public health, safety, comfort, morals, or general welfare  
of the inhabitants of DuPage County.

2. That the owner/developer is to apply for and receive a Building Permit for all  
construction and/or excavation that occurs on the property.  
3. That in conjunction with the submittal of a building permit the developer provides a  
landscape plan showing full landscape screens around the perimeter of the  
development and that landscape plan is to be submitted at time of the building permit  
for site development work.  
4. That as part of the regular building permit review process, the developer shall provide  
the required drawings and site plans to accommodate the required emergency services  
measures for emergency access for the proposed development.

the rear half of the subject property, creating little backyard space and a large  
front yard.

addition would be on the back of the house due to the location of the existing  
French doors.  
E. That the Zoning Hearing Officer finds that petitioner has demonstrated evidence for a  
practical difficulty and particular hardship, as petitioner testified that due to the shape  
of the lot, which is narrower in the front compared to the rear, the existing house was  
constructed in the rear half of the subject property, leaving creating little backyard  
space and a large front yard, and that the only location to place to proposed  
four-season addition would be on the back of the house in the same location as the  
existing three-season room.

consisting of a list of priorities for DuPage County to propose and support during the next  
session of the United States Congress (herein referred to as “2025 Federal Legislative

WHEREAS, to incorporate these changes and updates requires effort on the part  
of the CONSULTANT to revise and prepare new supporting technical analysis relating to

WHEREAS, bids have been taken and processed in accordance with County  
Board policy; and  
WHEREAS, the lowest most responsible bidder has been designated and the  
Transportation and Public Works Committees recommend County Board approval for the  
issuance of a contract purchase order to Al Warren Oil Company, Inc., to furnish and  
deliver gasoline and diesel fuel, as needed for the Division of Transportation and Public  
Works, for the period of April 1, 2025 through March 31, 2026.  
NOW, THEREFORE, BE IT RESOLVED that said contract to furnish and deliver  
gasoline and diesel fuel, as needed for the Division of Transportation and Public Works,  
for the period of April 1, 2025 through March 31, 2026, and is hereby approved for  
issuance of a contract purchase order to Al Warren Oil Company, Inc., 1646 Summer  
Street, Hammond, IN 46320, for a contract total not to exceed $1,750,000.00, second

Intergovernmental Agreement between the County of DuPage and York Township Road  
District, for the York Township 2025 Road Maintenance Program, Section  
25-09000-01-RS. (No County cost)  
WHEREAS, the County of DuPage (hereinafter referred to as COUNTY) and the  
York Township Highway Department (hereinafter referred to as TOWNSHIP) are  
authorized by the 1970 Illinois Constitution, Article VII, Paragraph 10 and by the  
Intergovernmental Cooperation Act 5 ILCS 220/1 et seq. to enter into agreements with  
each other; and  
WHEREAS, the COUNTY is required to hold on deposit Township Motor Fuel  
Tax funds, and when authorized by the TOWNSHIP with the approval of the Illinois  
Department of Transportation (hereinafter referred to as IDOT), enter into contracts for  
improvements to TOWNSHIP roads using said Township Motor Fuel Tax funds; and  
WHEREAS, the TOWNSHIP, has published a contract proposal for Section  
25-09000-01-RS (hereinafter referred to as the PROJECT) setting forth the terms,  
conditions and specifications; and  
WHEREAS, the estimated cost of said PROJECT is $64,223.00; and  
WHEREAS, the COUNTY is holding on deposit $64,223.00 in TOWNSHIP  
Motor Fuel Tax funds which will be authorized by IDOT for use on the PROJECT; and  
WHEREAS, an Agreement has been prepared and attached hereto which outlines  
the project and financial responsibilities between the COUNTY and the TOWNSHIP;  
and  
WHEREAS, said Agreement must be executed before the PROJECT may  
proceed.  
NOW, THEREFORE, BE IT RESOLVED that the DuPage County Chair is  
hereby authorized and directed to sign on behalf of the COUNTY, and the County Clerk  
is hereby authorized to attest thereto, the attached Agreement with the TOWNSHIP; and  
BE IT FURTHER RESOLVED that one (1) certified copy of this Resolution and one (1)  
duplicate original Agreement be sent to the York Township Highway Department  
Commissioner, by and through the Division of Transportation.
