AMENDMENT TO RESOLUTION AS-P-0165-22
ISSUED TO RWE DESIGN BUILD
TO PROVIDE PROFESSIONAL CONSTRUCTION MANAGER SERVICES

ON AN AT-RISK BASIS TO EXECUTE THE WORK SCOPE DETAILED

FOR THE ANIMAL SERVICES FACILITY ADDITION

FOR ANIMAL SERVICES

(INCREASE CONTRACT $2,488,898)

WHEREAS, the County of DuPage (“COUNTY”) and RWE Design Build (“CONSTRUCTION MANAGER”) entered into an Agreement under Resolution AS-P-0165-22 (“AGREEMENT”), which was adopted and approved by the County Board on May 24, 2022 to provide professional construction management on an at-risk basis; and

WHEREAS, the COUNTY and CONSTRUCTION MANAGER have further identified additional work that would be beneficial for the County to undertake at this time; and 

WHEREAS, construction management services are required for this additional scope of work; and

WHEREAS, the County Board has determined that due to building enhancements and added scope, including additional low voltage, access control, security, surveillance cameras, infrastructure for future solar panels and future electric vehicle charging stations for public and municipal use, switchgear and infrastructure for new transformer and electrical services; replace the existing roof with a standing seam roof, as further identified in Exhibit 1 and 2 of the attached revised project budget; and

WHEREAS, the County Board has determined that the value of the contract needs to be increased and extended; and

WHEREAS, the COUNTY and RWE Design Build have agreed to increase the contract amount by $2,488,898, taking the original contract amount of $10,967,013 resulting in a new amended contract amount not to exceed $13,455,911, a 22.69% increase; and

NOW, THEREFORE, BE IT RESOLVED that the DuPage County Board adopts Change Order Notice, dated November 28, 2023, to County Contract Purchase Order #5853-0001-SERV,  issued to RWE Design Build, to provide professional construction manager services on an at-risk basis; and

BE IT FURTHER RESOLVED that the DuPage County Clerk be directed to transmit certified copies of this Resolution and attached Change Order Request Form amending contract 5853-0001-SERV to RWE Design Build 1303 Ogden Avenue, Downers Grove, IL 60515, and to ASA Nicholas Alfonso, Civil Division / DuPage County State’s Attorney’s Office.
